Para la parte de Hacienda, basta con darse de alta con el modelo 036 o 037 en el censo Empresarios, Profesionales y Retenedores. A partir de entonces, ya puede uno emitir sus facturas y pagar su IVA normalmente.

Pero con la Seguridad Social (SS) es un poco más complicado. Para los que trabajamos por cuenta propia existe un régimen de cotización especial, el Régimen Especial de Trabajadores Autónomos (RETA). En teoría, el alta en el RETA de la SS es obligatorio, en el plazo de un mes desde el alta en Hacienda, para todos los trabajadores por cuenta propia. ¿Cuál es el problema? Que este régimen tiene una base de cotización mínima que acaba elevando la cuota mensual mínima hasta un poco más de 200€. Para muchos que estudiamos, los trabajos esporádicos constituyen una muy pequeña parte de nuestros ingresos, y los 200€ pueden incluso superar lo que ganamos, generando pérdidas. Total, que trabajas y encima pierdes dinero; pues vaya negocio.

Buscando en Internet para encontrar más gente con mi mismo problema y qué solución habían encontrado, lo más interesante que encontré fue este artículo sobre cómo evitar cotizar en autónomos. Básicamente, consiste en escribir una carta certificada a la Dirección Provincial de la Tesorería General de la Seguridad Social exponiendo tu situación y tu deseo de no cotizar en el RETA por no ser tu actividad “habitual”. A continuación reproduzco la carta que envié a la Seguridad Social:

A la atención de la Dirección Provincial de la Tesorería General de la Seguridad Social de Madrid:

Don Israel Saeta Pérez, abajo firmante, con DNI XXXXXXXX, número de la Seguridad Social YYYYYYYY, y domicilio en <alguna calle>,

EXPONE:

QUE se haya inscrito en el censo de empresarios, profesionales y retenedores de Hacienda, realizando la actividad de programador y analista informático, tal y como certifica la documentación adjunta.

QUE el ejercicio de esta actividad es esporádico y no constituye su fuente principal de ingresos. El interesado estima que esta actividad le exige una dedicación de menos de ZZ horas al mes y unos beneficios netos de menos de XXX € mensuales de media.

QUE el interesado es estudiante y su fuente principal de ingresos actual consiste en becas de estudios del Estado y apoyo económico familiar.

QUE, según la Orden de 24 de septiembre de 1970 por la que se dictan normas para aplicación y desarrollo del Régimen Especial de la Seguridad Social de los Trabajadores por Cuenta Propia o Autónomos (capítulo I, artículo 1), “se entenderá como trabajador por cuenta propia o autónomo aquél que realiza de forma habitual, personal y directa una actividad económica a título lucrativo”, pero la actividad que realiza el interesado no posee el carácter de habitualidad.

QUE, dados los bajos beneficios que al interesado le reporta la el ejercicio de la actividad citada, su inclusión en el Régimen Especial de la Seguridad Social de los Trabajadores por Cuenta Propia o Autónomos le llegaría a ocasionar pérdidas ciertos meses.

QUE, según el Artículo 31.1 de la Constitución Española vigente, “todos contribuirán al sostenimiento de los gastos públicos de acuerdo con su capacidad económica mediante un sistema tributario justo inspirado en los principios de igualdad y progresividad que, en ningún caso, tendrá alcance confiscatorio.”

SOLICITA:

QUE la Tesorería General de la Seguridad Social exima al interesado de la obligación de cotizar en el Régimen Especial de la Seguridad Social de los Trabajadores por Cuenta Propia o Autónomos.

La idea de publicar esta carta (y todo el post) es que, quien quiera, pueda utilizar esta carta como modelo en su petición. Hago especial incapié en el caracter inconstitucional de la obligación a inscribirte en un régimen de cotización que te genera pérdidas (alcance confiscatorio).

Tardé bastante en recibir respuesta de la SS, pero al final llegó y la reproduzco aquí para que os hagáis a la idea de lo que podéis esperar:

En contestación a su escrito de fecha XX/YY/ZZZZ, respecto a si procede su encuadramiento en el RETA, le informamos que según el artículo 2.1 del Decreto 2530/1979 de 20 de agosto, regulador de dicho Régimen, establece que “se entenderá como trabajador autónomo aquél que realiza de forma habitual, personal y directa una actividad económica a título lucrativo”. Ahora bien, se requiere que la actividad laboral que realiza tenga entidad suficiente por el tiempo de dedicación al trabajo y la contraprestación obtenida. En su caso en base a lo que nos indica, no parece que reúna los requisitos para encontrarse de alta en el mencionado Régimen Especial, ya que la actividad que desarrolla es de menos de XX horas al mes y percibe unos beneficios máximos de YYY Euros mensuales de media.

Asimismo el informamos que este escrito no tiene valos de certificado ni de justificante de la excepción de estar de alta  en el Régimen Especial de Trabajadores Autónomos, sino de mera comunicación de naturaleza informativa que se cursa en función de las previsiones contenidas en el artículo 35 g) de la Ley 30/1992 de Régimen Jurídico de las Administraciones Públicas y del Procedimiento Administrativo Común.

Estaría mejor si la respuesta fuese un justificante de exención de verdad, porque no sé a dónde podría ir a pedirlo, pero ya me quedo tranquilo porque no creo que de momento vengan a sacarme los dineros.

As they define it, its vision is to bring together student activists and free culture luminaries to discuss free software and open standards, open access scholarship, open educational resources, network neutrality, and university patent policy, especially in the context of higher education.

Below there is a summary of the notes I took during the conference. It doesn’t aim to be complete nor precise, but I hope it will provide an idea of what did we discuss about.

During the different keynotes and panels, we used, apart from the classical hand-up, the backchan.nl tool for audience intervention during conferences. Better than a massive Twitter, IMO.

After a short introduction, we started discussing about the politics of open networks. It was pointed out that we need to come up with a clear definition of net neutrality and push the ISPs to implement the policies we want. The politics-related meetings about net neutrality often include a lot of industry representation, but seldom people from other sectors of the population, which are also affected, as university campuses or consumers’ groups.

The three-strikes law to cut the access to the Internet can become extremely harmful in contexts where it’s being used as a platform for services like VoIP or TV, disconnecting the affected user completely, unable to make even emergency calls.

In general, the existence of a competitive market of ISPs, like the one in England, contributes to the natural enforcement of the net neutrality.

Controversely, one of the panelists, Timothy B. Lee, exposed his ideas about how to preserve the net neutrality without law regulations. You can read more about his ideas, and a quite long and in-deep paper, in his blog.

I’ve recently read bad news about net neutrality in Spain. Some of the major ISPs operating in the country, like Telefónica or Vodafone, claim a monetary compensation from companies that use their infrastructures for their business, like search engines, mobile apps distributors, or VoIP companies. I personally oppose the Internet to become another TV.

Next, Pat Aufderheide directed a keynote about the concept of fair use to reuse and remix existing culture. Fair use is perfectly legal in the US and should be encouraged, even enlarging or modifying non-copying policies for homework in schools. There’s a lot of interesting material about fair use in the Center for Social Media website.

Moving on to the topic of Open Access and Access to Knowledge, it was pointed out that Open Access in public universities is low-hanging fruit and we should contact these universities to encourage them to adopt this model. The Open University Campaign, a Students For Free Culture project, contains valuable information about this. Also, the Right to Reseach Coalition is an excellent source of info about how to demand the research work paid with our taxes to come back to us without having to pay additional unfair fees.

Unfortunately, some countries lack from copyright exceptions for libraries and universities, and the changes in the law, usually promoted by the industry, always tend to make it more restrictive.

We need to take the discussion about Access to Knowledge from experts to the “family dinner”, explaining current common behaviour that is or would be illegal under the current laws, to make the public aware of how are they affected and take part in the legal discussions about copyright laws.

Also, it was pointed out that personal meetings, faxes and phone calls are much more effective than emails or Facebook campaigns to make the politicians hear our opinion.

The next panel was about Open Educational Resources (OER). Eric Frank, from Flat World Knowledge (FWK), told us that textbooks are a major portion of the tuition costs in some countries. Flat World Knowledge provides a platform to create, publish and distribute quality, peer-reviewed, customizable and flexible-licensing books that are freely accesible online and affordable as printed copies. The people from FWK have observed that, even when there’s a free printable copy of the book available, some students prefer to buy the book, which makes this publishing model presumably sustainable.

The Michigan University OER Team (Open.Michigan) is working on an impressive list of projects to enable groups and individuals to openly share their work. These are mostly collaboration tools, supporting the idea of that the knowledge is not just “transferred” from teachers to students, but something socially constructed. Some of the most interesting are dScribe, a framework to help faculty staff to gather available educational material, clear possible copyright restrictions over it (so it can be published legally under certain circumstances) and reuse it to create and publish new OERs; or OERca, the free software platform that powers most of the dScribe framework.

Finally, Timothy Vollmer, from ccLearn, told us about how CreativeCommons is helping to the development of OERs, the available tools for adequately tag content for further indexing and discovery.

However, microblogging is sadly failing at the same point current social networks are: isolation. If you signup into Twitter, you won’t be able to share your micro-posts with Jaiku or Pownce users, among others. This makes users choose the biggest microblogging network to reach as more contacts as possible, which makes everybody more and more dependant of a central service/company, affecting the neutrality of the web and slowing down innovation.

Nobody would currently accept such lack of openness and neutrality in blogging, so why are we ok with it in microblogging? We need opensource microblogging platforms and reading clients, supporting interconnectivity between services and servers, freedom to migrate from one server to another keeping all your data and a flexible standard and documented API.

I’ve just read that in a README:

Laconica supports an open standard called OpenMicroBlogging
(http://openmicroblogging.org/) that lets users on different Web
sites or in different companies subscribe to each others’ notices.
It enables a distributed social network spread all across the Web.

:-) Could be Laconica the way to go?
